Perfect Day Copyright Policy
Perfect Day Social Inc respects copyright and expects the people who use Perfect Day to do the same. We respond to notices of alleged infringement under the Digital Millennium Copyright Act, and we terminate the accounts of repeat infringers.
If you believe your work was used without permission
Send a written notice to our designated agent with all of the following. The DMCA requires each element, and a notice missing any of them may not be effective.
- A physical or electronic signature of the copyright owner, or someone authorized to act for them.
- Identification of the copyrighted work you say was infringed. If several works are covered, a representative list is fine.
- Identification of the material you say is infringing, with enough detail for us to find it. A link, a screenshot, or the exact location in the app.
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
Where to send it
Perfect Day Social Inc, Copyright Agent support@perfectday.social, subject line “Copyright”
We are completing our designated agent registration with the U.S. Copyright Office and will list the full agent details here when it is recorded.
Misrepresenting that material is infringing can make you liable for damages, including costs and legal fees, under 17 U.S.C. §512(f). If you are not sure whether a use is infringing, talk to a lawyer first.
What we do with a notice
We review it and, where it is valid, remove or disable access to the material promptly. We tell the person who posted it, and we give them a copy of the notice.
If your content was removed and you think that was wrong
Send a counter notice to the same agent with:
- Your physical or electronic signature.
- Identification of the material that was removed and where it appeared before removal.
- A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the federal district court for the district where you live, or, if you are outside the United States, of any district in which we may be found, and that you will accept service of process from the person who sent the original notice or their agent.
If we receive a valid counter notice, we forward it to the person who complained. If they do not tell us within 10 to 14 business days that they have filed a court action to restrain the activity, we may restore the material.
Repeat infringers
We keep a record of notices. In appropriate circumstances, and at our discretion, we disable or terminate the accounts of people who repeatedly infringe.
